COLORADO SPRINGS, Colo. โ€” New court records are providing significantly more information about the deadly three-vehicle crash at Constitution Avenue and Murray Boulevard, including the identity of the 91-year-old man killed and the charges now facing the driver accused of causing the collision.

The victim has been identified as 91-year-old James Fornia.

Kari Kmiec, 42, is facing charges of vehicular homicide and driving under the influence in connection with Fornia’s death, according to Colorado court records and court documents obtained by The Gazette. Gazette

The development follows Kmiec’s arrest after the October 3 crash, which Patriots First Media previously reported.

What investigators say happened

The crash happened shortly before 1:30 p.m. Saturday, October 3, at Constitution Avenue and Murray Boulevard in eastern Colorado Springs.

According to court documents, Kmiec was driving a truck westbound on Constitution Avenue when she allegedly failed to follow a curve in the roadway and crossed into the turn lane at Murray Boulevard.

Her truck then struck a vehicle stopped at the eastbound traffic light. Fornia was a passenger in that vehicle and was pronounced dead at the scene. The vehicle’s driver was injured. Gazette

The force of the initial collision reportedly caused Kmiec’s truck to spin into a third vehicle. The occupants of that vehicle were not injured. Gazette

Initial information released by Colorado Springs police following the crash said investigators were examining speed and alcohol as possible factors. https://www.kktv.com

Court documents provide new details about alcohol investigation

Court documents now provide additional information about why investigators are pursuing a DUI allegation.

According to The Gazette’s review of the documents, Kmiec allegedly told investigators that she had consumed several shots of alcohol approximately an hour before the crash.

Investigators also performed impairment evaluations following the collision. Court documents state that two tests administered by officers produced indicators that investigators associated with impairment. Gazette

Those statements are allegations contained in court documents and have not been proven in court.

Witness reportedly intervened after crash

The court documents also describe the actions of a witness identified as a retired Colorado Springs police officer.

According to the documents, the witness directed Kmiec to sit on the curb after the crash after reportedly observing signs the witness believed indicated impairment. Gazette

Police subsequently continued their investigation at the scene.

The criminal case is ongoing.

The charges against Kmiec are accusations. She is presumed innocent unless and until proven guilty in court.
